Schedules of Condition

The purpose of a Schedule of Condition is to qualify the extent of the tenant’s repairing (or other similar) obligations by reference to the condition of the premises at the commencement of the lease – the end result is that the tenant is not obliged to put the property into a better condition than is evidenced by the Schedule of Condition. A schedule of condition survey is generally commissioned before the signing of a lease in order to determine the condition of the building so that any existing defects and their repair costs are identified prior to any commitment being made.

A commercial lease will usually require a tenant to undertake repairs during and at the end of the tenancy, the schedule of condition enables a tenant to negotiate any immediate defects ahead of taking responsibility for their repair and in most cases will enable the commercial tenant to limit their liability for repairs to future deterioration only. The methodical manner in which the commercial survey is undertaken will limit an aggressive landlord’s dilapidations claim at the end of the lease. A good schedule of condition appended to a commercial property lease can save significant amounts of money when a tenant vacates the property and they should not be overlooked.
